The City may be following the lead of several others in California and apply the same restrictions to electronic cigarettes and vaping devices as it does to smoking. A law making its way through the California Legislature may end up doing the same.
Currently, in addition to the statewide ban on indoor smoking, the city also bans smoking in parks. An ordinance up for consideration (link here) at Tuesday's City Council meeting will keep the same restrictions in place, but change the definition of "smoking" from "inhaling, exhaling, burning or carrying any lighted cigar, cigarette, pipe, or plant in any manner or in any form," to a more expansive definition to include these newfangled things they sell in every other strip mall:
holding, carrying, burning, emitting, inhaling or exhaling the fumes or vapor of a lighted or activated pipe, cigar, cigarette, electronic smoking device, or any other lighted smoking equipment used for burning any tobacco product, weed, plant, or any other combustible substance. The term applies to any electronic smoking device and/or an electronic or battery-operated device that delivers vapor for inhalation including every variation and type of such devices including electronic cigarettes, electronic cigars, electronic cigarillos, electronic pipes, electronic hookahs or any other similar product.
The reasoning for the new ordinance cites a recent study in the New England Journal of medicine that found formaldehyde (which can cause cancer) in exhaled vapors.
Also on Tuesday, the Council will consider ordinances that further define the city's power (or lack thereof) to regulate massage parlors and aggressive solicitation, or begging.
