November 2, 2011 Daily Brief-Our Long Nightmare is Over Edition!!!

  • Dodger Fans awoke this morning from their long nightmare to realize that come April 2012 baseball phenoms Clayton Kershaw, Matt Kemp, and Andre Ethier will still be on the roster; Vin Scully will still be calling play by play BUT grifter and fraudster Frank McCourt will no longer own the team!  Put me down for $1,000 to build a giant boot in Chavez Ravine to kick McCourt (and his shrew soon to be ex-wife) out of the city on opening day.
  • Lots of words but not much new on the Canyon Country shooting.  The SIGNAL has a heartfelt but confusing story that seems to indicate the homicide victim, still unidentified, was some kind of street preacher that may have ministered to the homeless.  SCVNEWS continues to misuse the term “Good Samaritan” like everyone does.  The victim was actually acting under the more modern concept of the citizen’s arrest  or posse comitatus, common law and statutory principles that allow ordinary citizens to intervene in a crime in progress and apprehend criminals.  And unlike the other recent daylight homicides in the SCV, ALL of the alleged perpetrators are currently in custody.
  • And in the “Sun will Rise Tomorrow” journalistic tradition, the SIGNAL reports that turnout for Vote Counting Day next Tuesday could be quite low, which leads to the following question:  Will Patrick Hill even get 500 votes?  And if he does not, will the SCV Young Republicans admit they are big losers for endorsing him?
  • CalArts reports second act of campus vandalism that may (or may not) have involved the painting of swastikas.  My theory:  The idiots that engage in this type of vandalism don’t even realize the historical offensiveness of the swastika and just have a vague idea that it will “shock.”
  • And in other evidence that Repubs are all for the free market unless they have to view it on a daily basis, Mike Redmond  , developer of the Newhall Gateway property, says he is selling the land and getting out of the real estate business due to frustrations and roadblocks put up by City Planners, the planning commission and the City Council.
  • I am not going to link to it because I almost puked, but the Signal publishes ten letters of support for the incumbent candidacy of Bruce Fortine.  Bruce’s reelection was assured when Diana Shaw decided to run her usual half ass campaign.

    All of the definitions that I have looked up roughly define “Good Samaritan” as “a compassionate person who unselfishly helps others.” Not sure how that would not apply in this case here. Regardless of it’s historical origins, this appears to be how it is used and defined. Not sure citizen’s arrest or posse comitatus applies here. Coming to the aid of another would not constitute an arrest, since there is no indication this was an attempt to take the suspect into custody. Furthermore, posse comitatus is an artifact (not sure if it is ever used anymore) whereby police can command you to assist them in taking someone into custody. How about we just agree that this guy died coming to the aid of someone he may not have even known? Personally, I will call him a good samaritan.

    Sorry, but as an amateur Bible scholar I have to go with Petz on this one. The common usage of the term “Good Samaritan” is completely wrong and when thus used the folks align themselves with people who think that Jesus coined many sayings actually written by Benjamin Franklin.

    RE: Dodgers Bankruptcy I’ve been a fan since the Dodgers beat the Yankees when I was a kid. Childhood rebellion against father who was a die hard Yankee fan. Anyway, I’ve been reading the Dodgers case court filings in the U.S. Bankruptcy Court for Delaware since the case was filed. In re Los Angeles Dodgers, Case No. 11-12010-KG. All L.A. Times reporting is being fed to them by Major League Baseball official or lawyers, and occasionally MLB has an attack blogger writing comments on the L.A. Times website. I went in the online docket this morning, and there’s nothing filed yet relating to any “auction” of McCourts’ ownership of the Dodgers, Dodger Stadium, Stadium Parking Lots, etc. When I did see is that a full blown hearing with live witnesses,which was scheduled for 10/31/11 was cancelled. The hearing was an attempt of MLB to take the first step on a long road to propose its own Chapter 11 Plan for the Dodgers, when at present the McCourt management has the exclusive right to approve such a plan. All of the proceedings are clouded by the presence of Fox Sports Net West 2, LLC D/B/A FSN Prime Ticket which has broadcase rights. A very broad based confidentiality stipulation covering all parties was approved by the judge on 10/19/11, so the ability of any news outlet to accurately report what’s going on is very limited. Anyway, if McCourts have agreed to a “bankruptcy auction” it’s probably going to be conducted under Bankruptcy Code Section 363. Bidders have to pre-qualify as to their creditworthiness and available cash (and probably as to their acceptability to MLB). The court pre-approves and opening bidder and its bid terms. Then there’s literally a live auction with one qualified party bidding against the other, and sometimes many bidders. The winning bidder has a deadline to “close escrow” with its cash, and if they don’t then the second highest bidder gets the deal. It will take at least 6 weeks for the documents to set up this sort of “363 Auction”, with McCourts, MLB, Fox and Unsecured Creditors Committing having to approve the rules of the auction before it occurs. It certainly would be interesting if the auction was televised but often the parties agree that only qualified bidders and the parties with standing in the case can be there. The last time there was a “really exciting” 363 Auction occurred with respect to something in the area was when the Bermite property in Santa Clarita was auctioned in the Phoenix bankruptcy court. Using a Lehman Brothers’ line of credit, developers named SunCal and Cherokee outbid the opening bidder (Lewis Brothers) bidding the auction up to a price of $66.5 Million, and then SunCal and Cherokee agreed to form a partnership and stop bidding against each other. The SunCal/Cherokee partnership had a time period to close escrow, and during that time period Lehman Brothers filed Chapter 11 and the deal didn’t close. The bankrupt property owner got to keep SunCal/Cherokee’s deposit money and last time I checked ownership of Bermite was still parked in the bankrupt Phoenix based owner. Generally, once the bankruptcy judge approves the deal terms of a 363 Auction, there’s no likelihood of a successful appeal to reverse the auction sale once the successful bidder “closes escrow”. However, both Fox and MLB are big gorillas in the court room so they may end up screwing up the sale of the Dodgers if the don’t like the outcome of the auction. I’m hoping for the sake of Dodgers fans that if and when the bankruptcy court judge in Delaware approves the mechanics of the 363 Auction of the whole Dodgers package, that the mechanics will be accurately reported, and that the auction will have some level of transparency so that Dodgers fans can understand who bid and who won. Big Bankruptcy Court battles fought by competitive lawyers are as much of an exciting sport as an exciting football game.

    CS: There is a precedent. Two years ago the Texas Rangers were sold in a bankruptcy auction to a group led by Nolan Ryan that outbid Mark Cuban. The difference is that MLB actually took the Rangers into bankruptcy to squeeze some minority partners in the old ownership group. Jungle drums indicate that the eventual purchaser will be a fairly large investment group fronted by a respected Dodger name, probably Orel Hershiser, future Hall of Famer and perfect person.

    Tim, Do you think McCourt will get a billion? According to Forbes the team is worth about 800 million, according to the news articles McCourt needs a billion to pay off all debt. I think Mark Cuban might jump in, if he can get it for the right price…paging Dr. Beuss!!!!

    My money is that as much as we want Cuban to take the team, he won’t. As much as it pains me, I agree with Tim. I think the team/Chavez ravine/TV rights is worth every bit of a Billion.

    Let’s look at what they have to offer. Overpaid crybabies playing a game. Team owners overcharging on everything from parking and tickets too concessions to help pay for said players. Ridiculous broadcast contracts too help pay for said players driving up the cost of commercial time which in turn drive up the cost to the consumer. NO sports franchise is worth that kind of $.

    The billion number would pay off the secured debts, the shrew ex-wife, and the projected liability to Bryan Stow. It could very well go down to $800 million and which point the shrew ex-wife and Bryan Stow, as unsecured creditors, get discharged in bankrupcty. Nobody cares about the shrew ex-wife but bad mojo for Bryan Stow.

    Mike Redmond most certainly has a legitimate complaint. After 2 years of effort, spending a lot of money, obtaining planning support and having his project approved by the planning commission, he got blindsided at a City Council meeting. One has to ask the question, if his project complied with all codes and requirements why was it turned down in the 11th hour? Plus why weren’t the codes and requirements updated to allow him to know exactly what was expected of him? Loosing Mike Redmond’s contribution to Santa Clarita probably means we will see a vacant lot at Railroaded (aka San Fernando Road) and Sierra for a very long to come.

    By “numerous” jobs bills, you mean there’s actually only one: S.1769-Rebuild America Jobs Act, which was introduced by Minnesota Democrat Amy Klobuchar. The OTHER one, H.R. 2940-Access to Capital for Jobs Creators Act, sponsored by Republican Kevin McCarthy (CA) has a title that actually has nothing to do with creating jobs. Rather, it Directs the SEC to revise rules governing an exemption from public offering requirements for limited offers and sales without regard to the dollar amount of the offering. NOT actually a jobs bill. Do your research, Mr. Petz!

    In God We Trust is not our nations motto… “E Pluribus Unum” is. This is the one the founders wanted, this is the motto we had during some of our brightest and darkest time. This is the motto the greatest generation had and the generation that fought the civil war. It was because of our motto… “Out of many, one” that the union had to fight that war. It was the motto we had during the War of 1812, Spanish American War, WWI and WWII… And here I thought you were all about the founding fathers…

    Let’s see, You can go with Deism, as most of our founding fathers did. Epicureanism sounds like a lot of fun, while Gnosticism is a drag if you’re the type who likes to get laid every now and then. If you’re the “Puff, puff, pass…” type, perhaps you want to give Rastafarianism a whirl. Taoism might be a good choice of you’re one of those “Meh, I’ll just go with the flow” types. Wicca? A lot of chicks are in to Wicca. If you mix that with a little Epicureanism and Rastafarianism, you’re in for one HELLUVA party! Aside from the potential eternal damnation, Satanism sounds just a bit too kinky.

    I think it is really interesting how easy posters here can make fun of God and those who believe in Him. Sorry, but you may want to actually talk to a believer and do more research before you make such blanket assumptive statements that are offensive to an awful lot of people. Personally I think that our nation would be better off to remember both mottos: “E Pluribus Unum” and “In God We Trust.”

    The significance was focused on In God We Trust…not the American Trinity, Reaffirming In God We Trust is significant in recognizing that Rights come from God…not man…not the UN …..and regardless of what your “man” Obama says, they are anything but univerrsal. Obama consistently leaves the Creator out of his description of rights in the Constitution. He gets the failing grade. Petz will graduate from PragerU , Summa Cum Laude and may very well be the Valedictorian.

    How do you know how much research I’ve done? How do you know whether or not I’ve spoken to a believer? Your advice might be good. But you should ask yourself the same questions. As to making fun, keep in mind they were in response to Petz comments and certainly were made in jest. I welcome any similar comments regarding Atheism. We’re in the minority here. It is your slogans that are being promulgated, not ours. Maybe you shouldn’t be so hypersensitive.

    Madder than hell at my fellow Talkers this morning after my report of bipartisan support for the reaffirmation of In God We Trust in the US House of Representatives. You know how much this means to Petz and the US Congress voted to reaffirm it and urge it’s placement on in all public buildings and schools. That is the fact, whether you like it or not. 396-9 with Ellison voting “Present.” Then Obama comes out and politicizes it by say God wants a jobs bill.     At issue is whether or not Congress is making the highest and best use of their time by wasting it in session reaffirming a motto that was never in question in the first place. To what purpose does this serve? Was the motto about to expire? Were there suggestions from the floor to replace the motto? Rather than uphold their pledge to create jobs, the congressional majority has decided to waste their time on matters of little interest to anyone other than their hard-right constituents. Where are the jobs, Mr. Boehner?
